NOTES: Sarah Lee Stewart married John F. Greer after the death of David S tewart. She soon divorced him and the following is the reason why: Jess e Eldrige (he was married to David Stewart and Sarah Lee's, daughter, Eli zabeth Riley Stewart) was mixed up in this case some way or other and pro bably stirred up the trouble between Adam Lea and the Greers. He was kno wn to be of that disposition. The state's case against Jesse Eldridge fo r (A&B) seems to have started in Oct 1852 and was continued until Apr 185 3. A case came up in Feb 1853 in the State of Tennesse vs Jesse Eldridge . The sheriff had been ordered to summons John F. Greer and Adam Lea to g ive evidence. John F. Greer did not show up but had evidently fled back t o Bledsoe County, Ten. A little after this Adam Lea was murdered. Cour t records show Adam Lee was killed on 7 Jun 1853. Adam Lee had to b e a relative of Sarah Lee\Lea Stewart(I think her nephew, son of John L . Lee). Then on 21 June 1853 William Greer was indicted by the grand jur y on a first degree murder charge for murdering Adam Lee on 7 June 1853 b y choking, beating, kicking etc. John Lea-Prosecutor, Henry Lea (brothe r of Adam), John Cannon, Hiram Poston, and Louisa Copeland to give eviden ce. Francis Lea swore in open court to give evidence. (Relationship o f Witnesses: Sarah Lee's granddaughter,Nancy Mae Stewart(b1853) marrie d a Richard Poston(b1844, son of Hiram Poston (b1812). The Copelands als o married into the Stewart Line).
On June 23, 1853, Sarah Lee Stewart Greer (David Stewart's widow who ha d married John F. Greer) petitioned for divorce from John F. Greer.
Then on June 21, 1854 the Grand Jury returned a bill of indictment agains t John F. Greer for murder in the 1st degree of Adam Lea on 7 June 1853 . The same ones listed above to give evidence.
The case against William Greer was continued from time to time, and it wa s not until 21 Feb 1855 when it came up for trail. William pleaded not g uilty. The jury found him not guilty of murder in the 1st degree, but di d convict him for murder in the second degree and he was sentence to 15 y ears. He appealed but the appeal was turned down.
On 19 Jan 1856 the case against John F. Greer was dropped.

MARRIAGE: Bond dated 12/15/1768-Rowan Co.,NC

BIOGRAPHY: Joseph Stewart was born about 1740. He was the son of Samue l Stewart & Lydia Harrison Stewart. His father Samuel moved to Rowan Co. , N.C. in 1757. Sometime about 1761 he was married to Sarah Gilbert in Ro wan Co., N.C. Sarah was the daughter of William Gilbert & Lucy Conway. J oseph & Sarah were probably married in either Stokes Co. or Yadkin Co., N C. Stokes County is adjacent to Yadkin Co. Their 1st child, David, was b orn in Stokes Co. Joseph lived in Stokes Co., NC during 1750 and by 175 1 he had moved back to Yadkin Co. NC. By 1768 he and his family had move d to Rowan Co., NC & in 1780 he was living in what ultimately became Wash ington Co., TN. Before TN became a state, the entire area was part of NC . By 1781 the county lines had been changed and where he lived was the n in Overton Co., TN where his son Samuel was born on 3-15-1781. This ar ea of TN is in the central part of the state just south of the current Ke ntucky border.
Joseph was one of the county's earliest settlers. The earliest mention o f land ownership of Joseph in this area appears in a deed (E-415, Overto n Co.,) recorded where Jesse Stewart, his son , sold 25 acres of land o n the Roaring River to John Lea on 2-14-1824. The land was on Matthews C reek and described a follows: "Beginning at a hickory & red oak the NE c orner of Samuel Stewart's tract of 50 acres, running thence north...inclu ding the plantation where said Stewart formerly lived, which land was gra nted to Joseph Stewart, deceased by the State of TN, No. 421, dated 3-9-1 784, founded on warrant 360, & made over to Jesse Stewart by Will, all wh ich will appear reference being has to the original grant & deed."
On 10-23-1782, Joseph received a grant for 285 acres in Washington Co., N C (now in TN). The price paid for the grant was 50 shillings for each 10 0 acres of th grant. On 9-20-1787, Joseph received a grant for 400 acre s in Green Co., NC , on the waters of Bent & Mulberry Creeks.
The earliest known name for this area was Watuga. In 1776, the people o f Wautaga Settlement petitioned to be annexed to the State of NC and th e Legislature established Washington Co., in 1777 & it included all of pr esent day Tennessee. The separate State of Tennessee was created in 179 6 & Overton Co. was ultimately created in 1806. The two above listed gra nts were to ultimately be in Overton Co. During the early 1800s the Cree k Indian War broke out & many of the pioneers of Overton Co. petitioned t he State Assemblly for the right to raise a force of 500 mounted men to f ight the various tribes of the Creeks. On 3-31-1813, 132 persons signe d this petition and forwarded it to the State Assembly. David Stewart, o ne of Joseph's sons, was the 90th person to sign the petition. Shortly t hereafter, David & a number of Overton mounted men from the County partic ipated in the Creek Indian War.
The area where Joseph and Sarah lived included a church & cemetery someti mes called Twelve Corners. Joseph's name appears in the minutes of the G reen River Assn. of Baptists which met at Dripping Springs Meeting Hous e in Barren Co., KY just to the north of Overton Co. as a messenger. Thi s meeting on Saturday, Jul 25, 1801, included the Roaring River Church an d messengers. The foundation of the old Roaring River Church can still b e seen near the Roaring River Cem. It is not known exactly when Joseph d ied, but it is known that he died sometime before 1824. This is known be cause in the land sale to John Lea in Feb. 1824, Joseph Stewart is said t o be deceased. When Jesse sold his father Joseph's land to John Lea in 2 -1824, he states that he gained title by a Will but no such Wil has bee n found. The Will could have been destroyed during the Civil War as man y records were. It is presumed that Sarah also died in Overton Co., an d both are buried in the Roaring River Cemetery.
Joseph's father in 1768 devised to him and his brother Benjamin the lan d he was living on. Benjamin sold 124 acres of this 508 acre tract to Ma tthew Brooks on 5/9/1775, leaving 384 acres. Four years later, 8/30/1779 , Joseph, Sarah, Benjamin and his wife Elizabeth sold the remaining 384 a cres to Brooks. Joseph and his family moved to TN, settling on Matthew s Creek, a branch of Roaring River, in what is now Overton Co. Jesse G . Stewart conveyed 2/14/1824, 25 acres, that had been granted to his fath er Joseph in 1784. NOTES: Thru extensive research, The Robertsons, the Boones and the Sevie rs knew each other at the Yadkin River, left together for the Holstein Ri ver and Wautaga for the French Lick, and the Illinois Country. BIRTH: The 1759, 1761, and 1768 tax lists of Rowan Co., North Carolina a re use to determine the birth order of the children. The 1759 tax list r ecords Samuel with his two adult sons, David and John Stewart. The 176 1 tax list records Samuel with his sons; David, John, Samuel, Joseph an d Isaiah. The 1768 tax list records Samuel with David, John, Joseph, Isa iah and Benjamin, the baby in the family. Researcher: Joyce Lindstrom.

Notes: On July 25, 2003, Eleanor Halstead informed me that DNA evidenc e has been proven to link David Stewart (abt 1734) and Joseph Stewart (ab t 1740) as brothers. These are the sons of Samuel Stewart and Lydia Harr ison.

NOTES: Per Eleanor Halstead 9-17-03. Bent Creek was in Washington Distr ict, then Green Co., then Jefferson Co., and is now in Hamblen Co., Tenne ssee. Bent Creek is a branch off the Nolachucky River, south of the Holst ein River. In 1783, The first tax list of Green Co. Tennessee lists tha t Joseph and Benjamin Stewart are listed paying taxes. In 1786, the secon d Saturday in July, Joseph Stewart and his wife is accepted by letter int o the Bent Creek Baptist Church.(From minutes of the Bent Creek Baptist C hurch, Green Co., Tennessee). On the 11th of March 1797, Joseph Stewar t and his wife Sarah were dismissed from the Bent Creek Baptist Church b y letter. Then they went to Knox Co, Tennessee. Joseph and Sarah's daug hter, Elizabeth, married John Raney in Knox Co. in 1798. There was als o a court case against Joseph in this county close to the time that his d aughter was married. "13 Jul 1798, John Hunt vs Danile Hill and Joseph S tewart, Knox Co., Tennesse, suit dismissed"
